Terms of Service

This Agreement consists of the following terms and conditions (hereinafter the “General Terms”) and terms and conditions if any, specific to the use of individual or joint Services (hereinafter the “Service Specific Terms”). In the event of a conflict between the General Terms and Service, Specific Terms, the Service Specific Terms shall prevail.

Acceptance of the Agreement

You must be of legal age to enter into a binding agreement in order to accept the Agreement. If you do not agree to the General Terms, do not use any of our Services. If you agree to the General Terms and do not agree to any Service Specific Terms, do not use the corresponding Service. You can accept the Agreement by checking a checkbox or clicking on a button indicating your acceptance of the Agreement or by actually using the Services.

Description of Service

Therapy, or counseling, is a confidential process where a client works with a trained professional in a safe environment to explore their thoughts, feelings, and behaviors. The goal is to help the client better understand themselves and others, identify areas for change, and develop coping mechanisms. It is a professional relationship between you and a trained counsellor/therapist who has the desire, willingness, and professional code of conduct and ethics to help you accomplish your individual or relationship goals.

Counselling/therapy involves sharing sensitive, personal, and private information that may, at times, be distressing. During counselling, there MAY be periods of increased anxiety. The outcome of counselling is often positive; however, the level of satisfaction for any individual is not predictable. Your counsellor is available to support you throughout the entire process.

Confidentiality

All interactions with Talk Space Counselling Services, including scheduling or attendance at appointments, the content of your sessions, progress in counselling, and your records, are confidential. No counselling record is contained in any academic, educational, or job placement file.

You may require the Counsellor/Talk Space Counselling Services to release specific information about your sessions to persons you designate.

The Counsellor works as part of a team, and as such, case files may be reviewed with the team members, but the client’s name and other identifying details will not be used in these sessions.

The Counsellor/Talk Space Counselling Services bears no responsibility for confidential information divulged by the client knowingly or inadvertently. The client is also responsible for keeping information of his/her session confidential, offline and online.

Exceptions to Confidentiality

  • The Counsellor/Talk Space Counselling Services is required by the Court of Law to release information in the client’s
  • If there is a possibility of miscarriage of
  • Suspicion/Detection or Disclosure of Physical abuse, sexual abuse, or neglect of any persons under the age of 18 years.
  • If Suicidal or Homicidal tendencies are
  • If Client is at risk of causing serious injury or harm to self or another
  • If the Client authorizes the Counsellor/Talk Space Counselling Services to release information

Length of Sessions, Overtime & Counselling Packages

Counselling is offered for 1 hour per session for individual therapy or 1 hour 30 minutes per session for couple therapy, which can be virtual or in person. Session timing does not cover overtime, which will be prorated and charged to the client.

Counselling packages are offered in bouquets of 4, 6, and 10 sessions after the first session. The maximum time of use for each bouquet is double the bouquet selected. For instance, a 4- 4-session bouquet MUST be completed within 8 weeks. Failure to utilize the bouquet within the period will lead to forfeiture of outstanding sessions except under extenuating circumstances.

Extenuating Circumstances

Suppose the client cannot utilize sessions within the stipulated period detailed above. In that case, extenuating circumstances allow for a maximum period of 6 months or December 20th of the calendar year the session is booked (whichever comes first). Failure to utilize sessions within the period will lead to forfeiture of outstanding sessions.

Abusive or Threatening Behaviors

Abusive or threatening behaviors by the Client or Counsellor are not acceptable. The Counsellor/Talk Space Counselling Services reserves the right to withdraw services if the Client becomes abusive or threatening.

Rescheduling of Sessions

Both the Counselor and Client are expected to give as much notice as possible if either is unable to attend a session. If a session is to be rescheduled, a 48-hour notice should be given. Cancellation with less than 48 hours’ notice will lead to forfeiture of 50% of the payment. Failure of the client to attend a session without notice will lead to full forfeiture of payment made.

Cancellations & Refunds

Refunds on sessions can ONLY be requested within 1 week of payment, AND with at least a 5-day notice period before the actual date of the session. Refunds requested within this period will be processed to the client less a 10% administrative charge. Cancellation with less than 5 days’ notice will lead to forfeiture of 50% of the payment made. Failure of the client to attend a session without notice will lead to full forfeiture of payment made.

Outside the above, payments made are not refundable, but the sessions are transferable (the client can give/gift the session to someone else).

I understand the risks and benefits of counselling, the nature and limits of confidentiality, and what is expected of me as a client while counselling. I also confirm that I am not under any duress or form of extortion to partake in the sessions.
